1. Description of Service

Ascent is designed to provide a curated, educational video feed focused on topics you select or discover. Our goal is to offer an engaging platform for learning that replaces mindless scrolling with valuable content discovery.

2. Eligibility

You must be at least 13 years of age to use the App. By using Ascent, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. Users in jurisdictions where the minimum age is higher must meet their local requirements.

3. Account and Usage

• Frictionless Onboarding: Ascent allows you to explore educational content without immediately creating an account.
• Subscriptions: We may offer premium features through subscriptions. Pricing, billing, and cancellation terms are presented transparently prior to purchase and are handled securely by your respective app store (e.g., Apple App Store or Google Play Store).
• Prohibited Conduct: You agree not to use Ascent for any unlawful purpose or in any way that interrupts, damages, or impairs the service. Attempting to reverse engineer the App or its algorithms is strictly prohibited.

4. Content and Moderation

• Educational Curation: Ascent curates publicly available videos from third-party platforms to match your interests. We do not claim ownership of these underlying videos, which remain the property of their respective creators and platforms.
• Third-Party Content: Ascent displays content sourced from third-party platforms including but not limited to YouTube. We are not responsible for the accuracy, availability, completeness, or legality of such content. Third-party videos remain subject to their original platform's terms of service and may be modified, removed, or made unavailable at any time without notice to us or to you.
• Algorithm Training: As further described in our Privacy Policy, we may use anonymized usage data to train our algorithms to deliver more personalized and higher-quality educational feeds.

5. Intellectual Property

The Ascent app, including its original design, interactive elements, features, and functionality (excluding third-party videos), is owned by us and is protected by international copyright, trademark, and intellectual property laws.

6. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the App or its features at any time, with or without notice, and without liability to you. We may also update, change, or remove content at our sole discretion.

7. Indemnification

You agree to indemnify, defend, and hold harmless Ascent and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

8. Disclaimer of Warranties

Ascent is provided on an "AS-IS" and "AS-AVAILABLE" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the curated content will always be completely error-free, accurate, or uninterrupted.

9. Limitation of Liability

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with your use of the App, whether based on warranty, contract, tort (including negligence), or any other legal theory. Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Texas.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes within the App. Your continued use of Ascent after such modifications constitutes your acknowledgement and acceptance of the updated Terms.
